1. The Agreement
By creating a TradeOS account or using the TradeOS product, you (the “Customer”) agree to these Terms of Service. If you are signing up on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. The Product
TradeOS provides a field service management platform for home service trade businesses. The product is delivered as software-as-a-service. We update it regularly. We may add, change, or remove features as the product evolves; if a change is material, we will notify you in advance.
3. Free Trial
New accounts get a 14-day free trial. No credit card is required to start the trial. At the end of the trial, you can choose to subscribe to a paid plan or let your account remain inactive. We will not automatically charge you.
4. Subscriptions, Pricing, and Billing
- Subscriptions are billed monthly or annually based on the plan you select.
- Annual plans are paid up-front and offer a discount.
- Prices are listed on the Pricing page and may change with at least 30 days' written notice to existing customers.
- All fees are non-refundable except as required by law or as explicitly stated in these Terms.
- You can cancel anytime. Cancellation stops future renewals; it does not refund prior payments.
5. Your Data
Your data is yours. You retain all rights to the customer records, jobs, quotes, invoices, photos, and notes you create or upload to TradeOS. You grant us a limited license to host, process, and back up that data so we can run the product for you.
6. Acceptable Use
You agree not to:
- Use TradeOS to send spam, phishing, or malware.
- Reverse-engineer, scrape, or otherwise abuse the product or its API.
- Resell, sublicense, or white-label TradeOS without a written agreement with us.
- Upload illegal, harmful, or infringing content.
- Attempt to access another customer's account or data.
7. Customer Communications
TradeOS lets you send invoices, quotes, and review requests to your customers via SMS and email. You are solely responsible for ensuring you have the right to contact those customers and for complying with applicable laws (TCPA, CAN-SPAM, GDPR, CASL, etc.).
8. Payment Processing
Payment processing for the invoices you send through TradeOS is provided by Stripe. Their Connected Account Agreement applies to that portion of the service.
9. Service Level
We aim for 99.9% uptime. We perform routine maintenance and will notify you of significant scheduled downtime in advance whenever possible. Status updates are posted at status.tradeos.app.
10. Termination
You can cancel anytime from the dashboard. We may suspend or terminate accounts that violate these Terms, attempt to defraud, or fail to pay. We will give 30 days' written notice before any non-emergency termination.
11. Disclaimers
TradeOS is provided on an “as-is” basis. We do not warrant that the product will be error-free or uninterrupted. Use of TradeOS does not replace the need for professional legal, accounting, or tax advice.
12. Limitation of Liability
To the maximum extent permitted by law, TradeOS' total liability to you for any claim arising out of or relating to these Terms or the product is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts of Delaware.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email at least 30 days before they take effect. Continued use after that date means you accept the new Terms.
